Fuel & Travel Policy Agreement

This Fuel & Travel Policy (“Policy”) forms part of the agreement between LUXEIA LTD, a company registered in England & Wales with its principal office located at 41 Monteigne Drive, Durham, England (“Company”), and any client (“Client”) engaging the Company for the provision of products or services that require on-site attendance.
By requesting or accepting any such services from the Company, the Client agrees to the following terms regarding fuel and travel charges:
1. Scope of Application
1.1 This Policy applies to all service types provided by the Company, whether paid, complimentary, promotional, or trial-based, which require personnel of the Company to travel to the Client’s specified location.
1.2 The terms set out herein are enforceable in conjunction with the Company’s general Terms and Conditions and any signed service agreements.
2. Standard Travel Inclusion
2.1 The Company shall provide travel for up to 50 (fifty) miles from its registered office address at no additional charge.
2.2 The 50-mile allowance is calculated using a single, one-way journey from the Company’s registered office to the Client’s service location, based on the shortest reasonable route.
3. Excess Mileage Charges
3.1 Where the Client’s location exceeds the standard 50-mile travel radius, the Client agrees to pay a fuel surcharge calculated at a rate of £0.45 (forty-five pence) per mile, for each mile beyond the initial 50 miles.
3.2 The surcharge shall be calculated on a one-way basis, using mapping software selected at the Company’s discretion (e.g. Google Maps), and will reflect the shortest or most time-efficient route.
3.3 The applicable surcharge shall be included in the Client’s quote, invoice, or contract documentation, and shall form part of the total amount payable.
4. Notification
4.1 The Company will make reasonable efforts to notify the Client in advance where a fuel surcharge is applicable.
4.2 It remains the Client’s responsibility to provide accurate service location details at the time of booking or quotation to allow for proper calculation of travel costs.
5. Additional Travel Provisions
5.1 Where services require travel across multiple days, to remote areas, or involve specific delivery, transport, or accommodation requirements, the Company reserves the right to apply additional reasonable travel or subsistence charges.
5.2 Any such charges shall be communicated to the Client prior to commencement of the services and agreed in writing.
6. Dispute and Interpretation
6.1 In the event of a dispute regarding travel distance or charges, the Company’s calculation shall prevail unless the Client provides demonstrable evidence to the contrary.
6.2 This Policy shall be governed by and construed in accordance with the laws of England, and any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
